These Terms of Use (“Terms”) govern your access to and use of the website located at 1stchoicedetoxtreatmentcenter.com (the “Site”), operated by 1st Choice Detox Treatment Center (“1st Choice Detox,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. ELIGIBILITY
The Site is intended for use by individuals 18 years of age or older, or by parents, guardians, or other authorized individuals inquiring on behalf of someone eligible for treatment. By using the Site, you represent that you meet this requirement.
2. NOT MEDICAL ADVICE, NOT AN EMERGENCY SERVICE
The Site provides general educational information about substance use disorders and treatment options. Nothing on the Site constitutes medical advice, and no content on the Site is a substitute for a professional clinical evaluation. Viewing this Site, submitting a form, or communicating with our staff through the Site does not create a patient-provider or treatment relationship. That relationship begins only upon formal admission to our program.
The Site is not monitored for emergencies and is not a crisis response service. 3. NO GUARANTEE OF OUTCOMES, ADMISSION, OR COVERAGE
Recovery outcomes vary by individual, and no treatment provider can guarantee a specific result. Nothing on this Site should be interpreted as a promise or guarantee of successful treatment, sobriety, or any other outcome.
Submitting an inquiry, contact form, or insurance verification request through the Site does not guarantee admission to our program, availability of a bed, or that your insurance will cover any portion of treatment. Insurance verification is an estimate based on information provided by your insurer at the time of the inquiry and is not a guarantee of payment or coverage. Actual coverage is determined by your insurance provider and your specific plan documents.
4. ACCEPTABLE USE
You agree not to:
– Use the Site for any unlawful purpose or in violation of these Terms
– Attempt to gain unauthorized access to any portion of the Site, its servers, or any connected systems
– Interfere with or disrupt the Site’s functionality, security features, or normal operation
– Use any automated system (bot, scraper, or similar tool) to access or collect data from the Site without our prior written consent
– Submit false, misleading, or fraudulent information through any form on the Site
– Impersonate any person or entity, or misrepresent your affiliation with any person or entity

7. USER SUBMISSIONS
Any information you submit through a form on the Site, including contact forms and insurance verification requests, is subject to our Privacy Policy and, where applicable, our Notice of Privacy Practices, both of which are incorporated into these Terms by reference. Do not submit information belonging to another person unless you are authorized to do so on their behalf, such as inquiring about treatment for a family member.
8. DISCLAIMER OF WARRANTIES
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR CURRENTNESS OF ANY INFORMATION ON THE SITE.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, 1ST CHOICE DETOX TREATMENT CENTER AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100).

10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless 1st Choice Detox Treatment Center and its owners, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any rights of a third party.
11. DISPUTE RESOLUTION: BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Agreement to Arbitrate. You and 1st Choice Detox Treatment Center agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (a “Dispute”) will be resolved through binding, individual arbitration, rather than in court, except as set forth below.
Exceptions. Either party may bring an individual action in small claims court for Disputes within that court’s jurisdiction. Either party may also seek injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
Class Action Waiver. YOU AND 1ST CHOICE DETOX TREATMENT CENTER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
Arbitration Procedure. The arbitration will be administered by a recognized arbitration organization under its rules then in effect, and will take place in Los Angeles County, California, unless you and we agree otherwise. The arbitrator’s decision will be final and binding, subject only to limited review as permitted by the Federal Arbitration Act.
Right to Opt Out. You may opt out of this arbitration agreement by sending written notice to the address below within 30 days of first accessing the Site. Your notice must include your name and a clear statement that you wish to opt out of arbitration. If you opt out, both you and 1st Choice Detox Treatment Center retain the right to resolve Disputes in court, and the Class Action Waiver in this Section 11 will not apply to you.
12. GOVERNING LAW
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles, except to the extent governed by the Federal Arbitration Act as described above.
13. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14. CHANGES TO THESE TERMS
We may update these Terms from time to time. The “Last Updated” date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
